Terms and conditions

1. Scope

These general terms and conditions apply to all orders placed on www.sexyfortunes.shop with [legal name] ("we", "us"). The version on this page at the time of your order applies to that order. We may change these terms for future orders. Other terms, including your own, only apply if we agree to them in writing.

2. Adults only

Our fortunes are about sex, kink and relationships, so we only sell to people who are 18 or older. You confirm this in the basket before you check out. If we have reason to believe an order was placed by someone under 18, we may cancel it and refund the payment.

3. How an order works

The products on our website aren't a binding offer, but an invitation to order. Ordering works like this:

1. Add products to the basket. There you can change quantities, remove items and add a discount code at any time.
2. Tick the box to confirm that you're 18 or older and agree to these terms, then select "check out".
3. You're taken to the secure payment page of our payment provider, Payrexx AG. There you enter your name, delivery address and email address, and choose how to pay. Before you pay, you can check and correct all your entries, or cancel and go back to the basket.
4. By completing the payment, you place a binding order, and the contract is concluded.
5. We confirm your order straight away by email.

Noticed a mistake in your order? Write to us as soon as possible. We'll fix it if your order hasn't been sent yet.

If we can't deliver something you ordered, for example because it has sold out, we tell you straight away and refund what you paid for it.

The contract language is English. You can print or save this page at any time.

4. Prices and payment

• All prices are in Swiss francs (CHF) and are final prices. [VAT: "We aren't registered for VAT, so no VAT is charged." or "They include Swiss VAT."]
• Shipping costs come on top. They're shown in the shop and in the basket before you check out. Shipping is free from CHF 50, counted on the value of the products before any discount.
• You pay when you order, through Payrexx: by TWINT, credit or debit card, Apple Pay or Google Pay.
• Discount codes: one code per order. A code takes a percentage off the products, not off shipping. It can't be exchanged for cash or applied to earlier orders.
• If a price or product description on our website is obviously wrong, we aren't bound by it. We then tell you, and you can either take the product at the correct price or cancel the order and get your money back.

5. Delivery

• We deliver within Switzerland with Swiss Post. Shipping to the EU? Please contact us at hello@sexyfortunes.shop before you order.
• We send your order within [1–2 working days] of payment, and Swiss Post usually delivers within [1–3 working days] after that. If we can't send your order in time, we let you know, and you can cancel it and get your money back.
• The risk of loss or damage in transit passes to you when we hand your parcel to Swiss Post (Art. 185 para. 2 Swiss Code of Obligations). If a parcel gets lost or arrives damaged, please tell us anyway: we'll take it up with Swiss Post and find a solution with you.

6. Returns

Swiss law gives no general right to cancel or return an online purchase. We still take back unused goodies (stickers and tote bags) if you change your mind:

• Let us know within 14 days of delivery, then send them back unused and as you received them to the address in the imprint. You pay the return postage.
• We refund the price of the returned items within 14 days of receiving them, to the payment method you used.
• Our cookies are food, so for food safety reasons we can't take them back. Defective cookies are of course covered under point 7.

7. Defects

• Please check your order when it arrives. Tell us about visible defects and wrong or missing items within 7 days of delivery, and about hidden defects as soon as you find them, ideally with a photo. Otherwise the goods count as accepted (Art. 201 Swiss Code of Obligations).
• If something is defective or not what you ordered, we send you a replacement at our cost or refund the price, as you prefer.
• Claims for defects expire two years after delivery.
• Our cookies are food: store them as stated in the food information and eat them by the best-before date. Spoiling from wrong storage or after the best-before date isn't a defect. Neither is normal wear and tear of stickers and tote bags.
• Please read the ingredients and allergen information before eating. The paper fortune inside isn't edible.

8. Liability

We're liable for damage we cause intentionally or through gross negligence. Our liability for slight negligence is excluded as far as the law allows. This doesn't affect our liability for personal injury or under the Product Liability Act.

We aren't liable for delays or failures caused by events outside our control, such as natural disasters, strikes, official orders or disruptions at Swiss Post.

9. The fortunes

The fortunes are for entertainment. They aren't advice, and we don't promise they'll come true. Whatever a fortune suggests: only with everyone's enthusiastic consent.

11. Applicable law and place of jurisdiction

• Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• If you buy for private use, you can take legal action against us at your place of residence or at our seat, and we can only take legal action against you at your place of residence. For business customers, the exclusive place of jurisdiction is [town], Switzerland.
• If any part of these terms is invalid, the rest remains valid.

Privacy policy

This policy explains which personal data we process when you visit our website, order from us or write to us, and why. It follows the Swiss Federal Act on Data Protection (FADP).

The short version

• No tracking, no analytics scripts, no ads, no social media plugins, no external fonts, and no cookies of our own.
• Your basket stays in your browser until you check out.
• We use your order details only to deliver your order, look after you if something goes wrong, and keep the records the law requires.
• We never sell your data or use it for advertising or profiling, and we draw no conclusions about your sex life or orientation from what you buy.

Visiting the website

Our website is hosted and delivered by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA, which also protects it against attacks. When you visit, your browser automatically sends technical data, such as your IP address, the date and time, the page requested, the referring page, and your browser and operating system. Cloudflare uses this data to deliver the website and keep it secure, and gives us anonymous, aggregated traffic statistics from which we can't tell who you are. If Cloudflare needs to check that a visitor isn't a bot, it may set a short-lived security cookie for that purpose only. Cloudflare keeps the data only as long as needed for these purposes; see the Cloudflare privacy policy.

Your basket

Your basket (products, quantities and any discount code) is saved in your browser's local storage, on your device, so it's still there when you come back. Nothing from it reaches us until you check out, except that a discount code you enter is sent to our server to check whether it's valid. You can refuse this storage by blocking or clearing the site data for sexyfortunes.shop in your browser settings. The basket then still works, but forgets its contents when you close the page.

Ordering and paying

When you check out, your browser sends the contents of your basket to our server, which sets up a payment page with our payment provider, Payrexx AG, Burgstrasse 20, 3600 Thun, Switzerland. On that page you enter your name, delivery address, email address and payment details. Payrexx and the provider of the payment method you choose (for example TWINT, your card issuer and the card networks, Apple or Google) process the payment details under their own responsibility; see the Payrexx privacy policy. We never see your full card details.

From Payrexx we receive your name, delivery address, email address, what you ordered and whether the payment went through. We use this to confirm and deliver your order, to handle questions, returns and complaints, and for our accounting. Without these details we can't deliver.

For delivery, we give your name and address to Swiss Post (Post CH AG, Bern).

Emails

When you email us, we use your address and message to reply. Emails to hello@sexyfortunes.shop are forwarded by Cloudflare and stored with [your email provider and its country].

Who receives data, and where

We only share personal data as described above: with Cloudflare, Payrexx and the provider of your payment method, Swiss Post and [your email provider], and where needed with our [accountant or fiduciary] and with authorities if the law requires it. Providers that process data on our behalf may only use it for us and must keep it secure.

Payrexx and Swiss Post are in Switzerland. Cloudflare is based in the USA and answers each request from a data centre near you, which can be in another country. Cloudflare is certified under the Swiss-U.S. Data Privacy Framework, for which the Federal Council has recognised an adequate level of data protection; for its other locations, Cloudflare's data processing terms include the standard contractual clauses recognised by the FDPIC. Payment method providers such as Apple, Google and the card networks may also process data abroad, including in the USA, under their own privacy policies. How long we keep data

We keep order and payment records for 10 years, as Swiss accounting law requires (Art. 958f Swiss Code of Obligations). We keep emails as long as we need them to help you, and longer only if they're part of our business records. Everything else we delete as soon as we no longer need it.

Security

Our website only works over an encrypted connection, and we collect as little data as we can.

Your rights

You can ask us at any time what personal data we hold about you, and ask us to correct or delete it, or to give it to you in a common electronic format. You can also object to how we use it. Just write to hello@sexyfortunes.shop. We may need to confirm who you are, and we may have to keep some data where the law requires it.

We don't make automated individual decisions about you.
